What is a postnuptial agreement?
A postnuptial agreement (or ‘postnup’) is a legal document created after marriage that outlines how finances, assets and other matters should be handled in the event of divorce or separation.
These formalised contracts can cover property, savings, pensions, business interests, inherited or gifted wealth, trusts, pensions and debts. They can cover both current and future wealth, even including wealth acquired after separation.
They can also include arrangements for children from previous relationships, helping to ensure they are provided for.
Why might I want a postnuptial agreement?
Once considered the preserve of the ultra-wealthy, postnups are an increasingly common feature of all modern marriages.
Couples choose postnuptial agreements for many reasons, including:

How long after marriage can you get a postnuptial agreement?

Are postnuptial agreements legally binding?
Not automatically, but provided the agreement is professionally prepared and drafted, it will carry weight and its terms will almost certainly be upheld.
Agreements must be fair and entered into freely, with a full financial disclosure. Both parties must have obtained independent legal advice and have a full understanding of the agreement’s implications. The agreement should, if possible, also provide for future changes.
The court retains discretion to create an order that has different terms to a postnuptial agreement. Self-written, ‘DIY’ postnuptial agreements are unlikely to be viewed favourably.
