What is a divorce financial settlement?

A divorce financial settlement is a legally-binding agreement between divorcing partners which details how matrimonial assets (such as property, businesses, savings, income and pensions) will be divided.

Divorce does not automatically terminate financial obligations. Having a formal agreement in place before it is finalised protects you from any future claims.

‘Clean break’ financial orders

Your agreement might include a specific clean break clause. This permanently severs financial ties between divorcing partners, except where child maintenance applies.

Once formalised by the court, a clean break order guarantees neither party can make financial claims at a later date, giving peace of mind.
